Terms of Service

By accessing or using TrafficSpy Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

TrafficSpy Pro is an SEO and web intelligence platform that provides estimated website traffic data, keyword research tools, competitor analysis, backlink data, rank tracking, and related features. The Service is provided on an "as is" and "as available" basis.

Important — nature of data: All traffic figures, revenue estimates, keyword volumes, and similar metrics are third-party estimates derived from aggregated data models, not verified actuals. They are intended for informational and research purposes only. Do not rely on them for financial, legal, or business-critical decisions without independent verification. Actual values may differ significantly from our estimates.

We may add, change, or remove features at any time, although we will make reasonable efforts to communicate significant changes to active users in advance.

You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this requirement.

Some features require you to register for an account. When you create an account, you agree to:

• Provide accurate and complete information.
• Keep your login credentials confidential and not share them with others.
• Be responsible for all activity that occurs under your account.
• Notify us immediately at dexteritydevelops@gmail.com if you suspect unauthorised access to your account.

You may use the Service without an account ("guest access"), subject to usage limits.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable local, national, or international law or regulation.
• Infringe, misappropriate, or violate the intellectual property rights of others.
• Transmit content that is unlawful, harmful, defamatory, or fraudulent.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Use automated scripts, bots, scrapers, or crawlers to extract data in bulk, or in ways that exceed your permitted quota or unreasonably burden our infrastructure.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or redistribute access to the Service without our prior written consent.
• Use the Service to harass, threaten, or harm any individual.

We reserve the right to investigate suspected violations and to take appropriate action, including restricting or terminating access and reporting violations to law enforcement.

The Service operates on a credit system. Guest users receive a limited number of free credits. Registered users receive credits based on their account tier. Credits are non-transferable and have no monetary value. We reserve the right to adjust credit allocations with reasonable notice.

The Service — including its interface, code, data models, algorithms, branding, and all content we create — is owned by or licensed to TrafficSpy Pro and protected by applicable intellectual property laws. You receive only a limited, non-exclusive, non-transferable licence to use the Service for your own personal or internal business purposes.

You retain ownership of any content you submit (such as feedback). By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use it solely for operating and improving the Service.

The Service is provided "as is" and "as available" without any warranties, express or implied, to the fullest extent permitted by applicable law. We specifically disclaim:

• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
• Any warranty that the Service will be uninterrupted, error-free, or virus-free.
• Any warranty that traffic estimates, revenue figures, keyword data, or other metrics are accurate, complete, or current. These are estimates only and may be materially incorrect.
• Any warranty that results from using the Service will meet your specific requirements.

Some jurisdictions do not permit the exclusion of implied warranties; in such cases, the above exclusions apply only to the maximum extent permitted by local law.

To the maximum extent permitted by applicable law, TrafficSpy Pro and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the greater of: (a) the total fees you paid to us in the 12 months preceding the claim, or (b) USD $10.

EU / UK users: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under mandatory consumer protection law in your country of residence. EU and UK consumers retain all statutory rights that cannot be contractually waived.

You agree to defend, indemnify, and hold harmless TrafficSpy Pro and its operators from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any law; or (c) any content you submit to the Service that causes harm to a third party.

We may update these Terms from time to time. For material changes — changes that significantly affect your rights or obligations — we will provide at least 14 days' advance notice by email to your registered address before the changes take effect.

If you do not agree to a material change, you may close your account before the effective date by contacting dexteritydevelops@gmail.com. Continued use after the effective date constitutes acceptance of the updated Terms.

By you: You may stop using the Service and close your account at any time by emailing dexteritydevelops@gmail.com.

By us: We may suspend or terminate your account for material violations of these Terms (for example, fraudulent activity, illegal use, or sustained abuse of our infrastructure). For minor or first-time violations, we will generally notify you and allow you to remedy the issue first, unless immediate action is necessary to protect users or the Service. We will notify you of termination by email unless doing so is legally prohibited.

Sections 7, 8, 9, 10, 13, and 14 of these Terms survive termination.

These Terms are governed by the laws of India, without regard to conflict-of-law provisions. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of India.

EU / UK users: Nothing in this section removes your right to bring a claim before the courts of your country of residence or to benefit from mandatory consumer protection provisions of local law.

We encourage you to contact us first at dexteritydevelops@gmail.com to attempt to resolve any dispute informally before pursuing formal legal proceedings.

• Entire agreement: These Terms, together with our Privacy Policy and GDPR page, constitute the entire agreement between you and TrafficSpy Pro regarding the Service.
• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce any provision is not a waiver of our right to enforce it in future.
• Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including internet outages, third-party service failures, or natural disasters.
• Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights in connection with a merger, acquisition, or sale of substantially all of our assets.
